Annual appropriation provided and method of

CHAPTER 86.

OF STATE BOARD OF HEALTH.

AN ACT to Amend Chapter 74, Volume 26, Laws of Delaware, entitled "An Act to provide for the distribution of Antitoxin by the State Board of Health of Delaware" by granting an additional appropriation to the Board of Health of the State of Delaware.

Be it enacted by the Senate and House of Representatives of the State of Delaware, in General Assembly met:

That said Chapter and Volume be and the same is hereby amended by adding the following, which shall be and is hereby declared to be Section 6 of said Chapter and Volume.

Section 6. That the sum of Five Hundred ($500.00) Dollars annually be appropriated to the State Board of Health of Delaware for carrying into effect the prorants for same visions of this Act, and the same is hereby annually ap

propriated out of any funds in the hands of the State Treasurer, not otherwise appropriated. The said appropriation hereby made shall be paid by the State Treasurer by warrants signed by the President and Secretary of the State Board of Health, and approved by the Governor of the State of Delaware, and the accounting shall be kept in the same manner as prescribed in Section 5 of this Act.

CHAPTER 87.

OF INSURANCE COMMISSIONER

AN ACT authorizing the Insurance Commissioner to appoint a
Deputy.

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

Section 1. The Insurance Commissioner shall have Authorizing authority to appoint a Deputy who shall have power to Commissioner perform all the duties of the Commissioner in case of his Deputy absence or inability to act from any cause; before entering upon his duties shall execute a bond in the sum of Ten Thousand Dollars ($10,000.) to be approved in the To bond same manner as the Bond of the Commissioner; he shall also take an oath of office in the same manner as the Commissioner, which bond and oath shall be filed in the Department of the State.

Section 2. The Deputy so appointed shall also be To be Deputy Deputy Commissioner of Banking and shall have powers Commissioner to perform all the duties of the Commissioner in case of his absence or inability.

Section 3. This Act shall not be effective after the Act not effectexpiration of the Term of the present incumbent as Insurance Commissioner for the State of Delaware.

Warranties in application for

Policies

CHAPTER 88.

OF INSURANCE COMMISSIONER.

AN ACT Relating to Warranties in the applications for Life Insurance Policies.

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

Section 1. That hereafter whenever the application Life Insurance for a policy of life insurance contains a clause of warranty of the truth of the answers therein contained, no misrepresentation or untrue statement in such application made in good faith by the applicant, shall effect a forfeiture or be a ground of defense in any suit brought upon any policy of insurance issued upon the faith of such application, unless such misrepresentation or untrue statement relate to some matter material to the risk.

When wrong age has been given in any application

Section 2. Whenever it shall be made to appear that a wrong age has been given in good faith in any application for a policy of life insurance, the company shall not be required to pay the face value of the policy, but such sum as the premium paid would have purchased at the applicant's real age at the time of effecting the insur

ance.

CHAPTER 90.

OF INSURANCE COMMISSIONER.

AN ACT regulating the use of the word “mutual” by Fire Insurance
Corporations or Associations.

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

Section 1. Every domestic mutual fire insurance corual" regulated poration or association shall embody the word "mutual" in its title, which shall appear on the first page of every policy and renewal receipt. Every fire insurance corporation or association doing business as a cash stock corporation or association shall upon the face of its policy in some suitable manner state that such policy is a policy in a stock corporation or association.
