CHARGE 2d--“ Behaving himself with contempt and disrespect toward his Commanding Officer.

SPECIFICATION" In this: that he, the said George D. Wiseburn, Second Lieutenant, 133 New York Volunteers, did behave himself with disrespect toward the President, the Commander-in-Chief of the Army of the United States, by using the following words, to wit: The Executive has seen proper to make it [the Army] the emancipation of the negro slaves.' This at Baton Rouge, Louisiana, on or about the 4th day of February, 1863."

CHARGE 3d--" Conduct to the prejudice of Good Order and Military Discipline.”

SPECIFICATION" In this: that the said George D. Wiseburn, Second Lieutenant 133 New York Volunteers, did, in tendering his resignation, use the following words: 'I humbly beg to decline serving any longer in the Volunteer Army of the United States;' he having stated as reasons the following, to wit: The Executive has seen proper to make it [the Army] the emancipation of the negro slaves; and He has seen fit, by his recent proclamation, to say that all colored persons of good condition will be received into the armed service of the United States, thus making the negro my equal.' All of which is to the prejudice of good order and military discipline. This at Baton Rouge, Louisiana, on or about the 4th day of February, 1863."

To which charges and specifications the accused, Second Lieutenant George D. Wiseburn, 133d New York Volunteers, pleaded as follows:

CHARGE I.

To the specification--" Not Guilty to so much as is contained in brackets- [the Army]."

To the charge--"Not Guilty."

FINDING.

The Court, having maturely considered the evidence adduced, finds the accused, Second Lieutenant George D. Wiseburn, 133d New York Volunteers, as follows:

SENTENCE.

And the Court does therefore sentence him, Second Lieutenant George D. Wiseburn, 133d New York Volunteers, "to receive a public reprimand, to be published before the Army of the Gulf, and ordered to Ship Island for two years, upon such duty as the General Commanding the Department of the Gulf may direct.”

IV.

The proceedings of the Court in the case of Private Henry Wright, Company C, 7th Vermont Volunteers, have been approved by the proper Commanders, and forwarded for the action of the President of the United States. Upon the recommendation of the members of the Court, and of the Major General Commanding the Department of the Gulf, the President directs that the sentence be remitted. The prisoner will be released from arrest and restored to duty.

The proceedings of the Court in the case of Private John Campbell, Company D, 26th Indiana Volunteers, have been approved by the proper Commanders, and forwarded for the action of the President of the United States, who approves the sentence, and directs that it be carried into execution, at such time and place as the Commanding General of the Department of the Gulf may direct.

The proceedings of the Court in the case of Second Lieutenant George D. Wiseburn, 133d New York Volunteers, have been approved by the proper Commanders, and forwarded for the action of the President of the United States who, upon the recommendation of the Major General Commanding the Department of the Gulf, directs that Lieutenant Wiseburn be dismissed the service of the United States, from the 7th day of November, 1863.

Private John Campbell, Company D, 26th Regiment Indiana Volunteers, will be shot to death with musketry, between the hours of sunrise and sunset, on the 20th day of January, 1864 The Commanding officer of the 2d Division, 13th Corps, is charged with the execution of this order,

Complaints having been made to these Headquarters that peaceable private families are frequently annoyed by visits of unauthorized persons, officers and soldiers of the army, and civil employees of the Government, the Commanding General directs that persons residing within the limits of this Department shall not be disturbed in the possession of their houses without the exhibition of written orders from proper military authority, or from an authorized agent of the Treasury Department.

The Provost Marshal General is charged with the due execution of this order; and violations of its terms or spirit will be taken cognizance of by the Provost Courts.

On and after the 1st day of January, 1864, the wages of mechanics, laborers, and other employees on steamboats and railroads, in machine shops, foundries, ship-yards, etc., will be established and paid as follows, viz:

All employees of the Government, in the absence of special contract, will be held to service until properly discharged, and will be exempted from the draft or compulsory military service during the period of such employment.

Mechanics, laborers, or other employees, who desert their employment without proper discharge, or who prove dishonest or unfaithful to the Government, will be held to military service, or such punishment as may be enforced by the military court.

Hospital accommodations will be furnished to all employees of the Government, in case of sickness, without other charge than the usual hospital tax, which will be deducted from their wages as heretofore, and stopped on the monthly rolls. The wages of all other persons employed in the Quartermaster's Department will be regulated and paid by the Chief Quartermaster.
