GENERAL ORDERS

HEADQUARTERS, DEPARTMENT OF THE GULF, 19TH ARMY CORPS,

No. 58.

New Orleans, August 10, 1863.

I. Before a General Court Martial, convened at New Orleans, La., pursuant to General Orders No. 28, of July 22, 1863, from Headquarters, Defences of New Orleans, and of which Colonel THOMAS W. CAHILL, 9th Regiment Connecticut Volunteers, is President, were arraigned and tried :

1. Captain Charles Blober, 1st Louisiana Cavalry.

CHARGE FIRST.

"Conduct to the prejudice of Good Order and Military Discipline."

SPECIFICATION 1st--" That the said Captain Charles Blober, Company G, 1st Louisiana Cavalry, was seen drunk in the city of New Orleans, on or about the 16th day of July, 1863."

SPECIFICATION 2d-"That the said Captain Charles Blober, Company G, 1st Louisiana Cavalry, did, on or about the 16th day of July, 1863, ride his horse upon the banquette on Prytania street, in said city of New Orleans."

SPECIFICATION 3d-"That the said Captain Charles Blober, Company G, 1st Louisiana Cavalry, did, on or about the 16th day of July, 1863. use violent and abusive language towards Mr. Peel, a citizen of New Orleans, all of which conduct did bring disgrace upon the Federal service."

CHARGE SECOND.

"Breach of Arrest.”

SPECIFICATION" That said Captain Charles Blober, Company G, 1st Louisiana Cavalry, while under arrest from these Headquarters, did quit the quarters assigned him by Captain Pickering, Provost Marshal, Defences of New Orleans. This on or about the 16th day of July, 1863. And that, when out of his quarters, and drunk, did assault an officer of the Navy, E. C. Gabandan, Secretary of Rear Admiral Farragut, calling him out of a private house, where he was visiting. All this on or about the 16th day of July, 1863."

To which charges and specifications the accused pleaded as follows:

To the 1st specification, 1st charge-" Not Guilty."

To the 2d specification, Ist charge-" Not Guilty."

To the 3d specification, 1st charge--" Not Guilty."

To the 1st charge-" Not Guilty."

To the specification of the 2d charge-"Guilty, excepting that part relating to insulting an officer of the Navy."

To the 2d charge- —“ Guilty.”

After mature deliberation on the evidence adduced, the Court finds the accused as follows:

Of the 1st specification, 1st charge—" Not Guilty."

Of the 24 specification, 1st charge--" Guilty."

Of the 3d specification, 1st charge--" Guilty."

Of the 1st charge--" Guilty."

Of the specification, 2d charge

Guilty, excepting that part relating to being drunk and insulting Mr. E. C. Gabandan, Secretary of Rear Admiral Farragut." Of the 2d charge, the Court accepts the plea of the prisoner, and finds him-"Guilty."

And does therefore sentence him, Captain Charles Blober, Company G, 1st Louisiana Cavalry," to be cashiered.”

2. Second Lieutenant J. H. Bowley, 133d Regiment New York Volunteers.

CHARGE FIRST.

"Absence without Leave."

SPECIFICATION" That he, the said Second Lieutenant J. H. Bowley, 133d Regiment New York Volunteers, did absent himself from bis command on or about May 23, 1863, (his regiment being at that time in the face of the enemy,) without the consent of the commanding officer of his regiment or brigade, and proceed to the city of New Orleans, La. ; and that the said Second Lieutenent J. H. Bowley, 133d Regiment New York Volunteers, did remain so absent until July 23, 1863, when he was arrested by Secord Lieutenant Garry T. Scott, 9th Regiment Connecticut Volurteers, in command of patrol guard. This at New Orleans, La., on or about the time above specified."

CHARGE SECOND.

Disobeying the lawful Commands of his Superior Officer."

SPECIFICATION "That he, the said Second Lieutenant J. H. Bowley, 133d Regiment New York Volunteers, after having been duly ordered, July 20, 1863, by Second Lieutenant Garry T. Scott, 9th Regiment Connecticut Volunteers, in command of patrol guard, in accordance with orders received from Colonel Thomas W. Cahill, to report immediately to Colonel Thomas W. Cahill, Military Commander of the city of New Orleans, La., did not obey said order, and did not report to Colonel Thomas W. Cahill until arrested, July 23, 1863, by Second Lieutenant Garry T. Scott, officer of the patrol guard. This at New Orleans, La., on or about the time above specified."

CHARGE THIRD.

“Using Contemptuous and Disrespectful Language against his Superior Officer.” SPECIFICATION" That he, the said Second Lieutenant J. H. Bowley, 133d Regi ment New York Volunteers, did state, on or about July 23, 1863, at the Headquarters of the 2d Brigade, Defences of New Orleans, La., that Colonel Cahill had woke up

the wrong customer, and that he (the said Second Lieutenant J. H. Bowley, 133d Regiment New York Volunteers) would proceed to the Convalescent Camp as directed by Colonel Cahill, but that he (the said Second Lieutenant J. H. Bowley, 133d Regiment New York Volunteers) would leave the Convalescent Camp the next day, so that Colonel Cahill could prefer charges against him for breach of arrest,' or words to that effect. This at New Orleans, La., on or about the time above specified."

To which charges and specifications the accused pleaded as follows:

To the specification, 1st charge Not Guilty."

To the 1st charge-" Not Guilty."

To the specification, 2d charge--" Guilty."

To the 2d charge--" Guilty."

To the specification, 3d charge--" Guilty, excepting to that part relating to his having said he would leave the Convalescent Camp the next day, so that Colonel Cahill could prefer charges against him for breach of arrest." "

To the 3d charge--" Not Guilty."

After mature deliberation on the evidence adduced, the Court finds the accused, Second Lieutenant J. H. Bowley, 133d Regiment New York Volunteers, as follows: Of the specification, 1st charge--“ Guilty.”

Of the 1st charge-Guilty."

Of the specification 2d charge-“ Guilty.”

Of the 2d charge--" Guilty."

Of the specification, 3d charge--“ Guilty.

Of the 3d charge-- Not Guilty."

And the Court does therefore sentence him, Second Lieutenant J. H. Bowley, 133d Regiment New York Volunteers, "to be dismissed from the service of the United States, with forfeiture of all pay and allowances now due or to become due."

3. Private Francis Scott, Company F, 1st Regiment Louisiana Volunteers.

CHARGE FIRST.

"Violation of the 7th Article of War."

SPECIFICATION 1st-" That he, the said Private Francis Scott, Company F, 1st Regiment Louisiana Volunteers, did, by force of arms, resist and wilfully and deliberately disobey the lawful orders of his superior officer, Major J. D. Bullen, 28th Regiment Maine Volunteers, while in the discharge of his duty."

SPECIFICATION 2d--" That he, the said Private Francis Scott, Company F, 1st Regiment Louisiana Volunteers, did wilfully and with malice aforethought, raise his musket and deliberately shoot at Major J. D. Bullen, in command of the pest, while in the discharge of his duty, wounding him so mortally that he died within two hours. This at Fort Butler, Donaldsonville, La., on or about the 5th day of July, 1863."

SPECIFICATION

CHARGE SECOND.

"Violation of the 9th Article of War."

That he, the said Private Francis Scott, Company F, 1st Regiment Louisiana Volunteers, did shoot to death Major J. D. Bullen, 28th Regiment Maine Volunteers, on the night of the 5th July, at Fort Butler, Donaldsonville."

To which charges and specifications the prisoner pleaded as follows:
To the 1st specification, 1st charge-" Not Guilty."

The Court, having maturely considered the evidence adduced, finds the accused, Private Francis Scott, Company F, 1st Regiment Louisiana Volunteer Infantry, as follows:

Of the 1st specification, 1st charge-" Guilty of so much as reads, did by force of arms resist his superior officer, Major J. D. Bullen, 28th Regiment Maine Volunteers.'" Of the 2d specification, Ist charge-" Guilty."

Of the 1st charge--" Guilty."

Of the specification, 2d charge-" Guilty."

Of the 2d charge-" Guilty."

And the Court does therefore sentence him, Frivate Francis Scott, Company F, 1st Regiment Louisiana Volunteer Infantry, "to be shot to death, at such time and place as the Commanding General may direct;" two-thirds of the members concurring therein.

II. The proceedings, findings and sentences in the cases of Captain Charles Blober, Company G, 1st Louisiana Cavalry, and Second Lieutenant J. H. Bowley, 133d Regiment New York Volunteers, are approved. They cease from this date to be officers in the military service of the United States.

The proceedings, findings and sentence in the case of Private Francis Scott, Company F, 1st Regiment Louisiana Volunteers, are approved. He will be shot to death, with musketry, between the hours of sunrise and sunset, on Friday, the fourteenth (14) day of August, 1863. Brigadier General Emory, commanding the Defences of New Orleans, is charged with the execution of this order.

I. So much of General Orders Nos. 50 and 53, current series, from these Headquarters, as requires that commissioned officers promoted to a higher grade in their own regiments, shall be discharged in Special Orders before being remustered on their new commissions, is hereby rescinded. Hereafter, in such cases, the proper Assistant Commissary of Musters will muster the officer out of service in the grade previously held, and muster him into service upon his new commission, without further orders; but under no circumstances can such musters be dated back prior to the day when the commission was actually received by the officer. The Department Commander has no authority to make any exception from this rule.

II. Commanders of Divisions, detached Brigades and Districts will immediately report the number of books of each kind required to make up, with the supply already on hand, the following allowance :
