In 1882 the following amendment was ratified by the people as Section 26 of the Bill of Rights: "No person shall manufacture for sale, or sell, or keep for sale, as a beverage, any intoxicating liquors whatever, including ale, wine and beer. The General Assembly shall by law prescribe regulations for the enforcement of the prohibition herein contained, and shall thereby provide suitable penalties for the violation of the provisions hereof." The amendment providing for biennial elections met with a similar fate. Having been ratified in 1900 as Section 16 of Article XII, it was held unconstitutional by the Supreme Court in the case of State ex rel. Bailey vs. Brookhart.
