refolution of the committee on the letter of the 6th of November, 1783, from the legislature of New Hampshire, touching the proceedings and fentence of the court of ap. peals in cafes of capture, on the cafe of the brig Lufannah, be further postponed till to morrow,

On the report of the committee of qualifications, confifting of Mr. Sherman, Mr. Jefferfon, Mr. Beatty, Mr. Chafe and Mr. Williamfon.

Whereas by the fifth of the articles of confederation and perpetual union of the United States, it is agreed, "that for themore convenient management of the general interest of the United States, delegates fhall be annually appointed in fuch manner as the legislature of each flate fhall direct, to meet in Congrefs on the first Monday in November, in every year, with a power referved to each ftate, to recal its delegates or any of them, at any time within the year, and to fend others in their stead, for the remainder of the year."

Refolved, That the feveral ftates be requested annually to appoint their delegates to ferve in Congrefs for one year, to commence on the first Monday in November next enfuing the time of their appointment; and when vacancies fhall happen by the removal or refignation of any of the faid delegates within the year, fuch flates be requested to appoint others in their flead, to ferve only for the remainder of the year; and to furnish their dem legates fo appointed with commiffions, or other credentials, under the feal of the ftate, particularly specifying the time for which they are appointed.

The committee of qualifications having further reports ed that Mr. Ofgood, was on the 14th February 1781, by the legislature of the ftate of Malachuferts, appointed a delegate for that state to Congrefs, from that time until the first Monday in November then next, 'iu confequence thereof he took his feat in Congrels,on the 12th day of June 1781. That on the 25th of the faid Jane, he was again appointed to the faid office for one year, commencing the first Monday in November then next, and on the 7th of June 1782, he was again elected for one year, to commence the first Monday of November then next, and on the 9th day of July 1733, he was again VOL. elected for one year, to commence the first Monday in November 1783.-That he accepted the faid trust under each of faid appointments.-That on the first day of March 1781, the articles of confederation were finally ratified, whereupon the committee are of opinion,that by the 5th article of the confederation, the faid Mr. Ofgood became incapable of being a delegate in Congress after the first day of March 1784, he having been a delegate three years expiring on that day, fince the final ratifica tion of the faid articles.

A motion was made by Mr. Gerry feconded by Mr. Partridge, to poftpone the confideration of the opinion reported by the committee in order to take into confideration the following.

After the statement of facts as made by the committee, and adding," but the members then in Congress, being appointed previous to and not under the articles of the confederation, and nothing appearing in the credentials of those members to authorife them to fit in two Congrefs. es differently conftituted, and it being also reasonable to conclude that the first federal year, commenced the first Monday of November 1781: Refolved, That Mr. Ofgood is capable of being a delegate till the firft Monday of November, 1784."

And on the queftion to poftpone for the purpose abovementioned, the yeas and nays being required by Mr.

Gerry.

On the report of a committee confifting of Mr. Howell, Mr. Chafe and Mr. Lee, to whom was referred a letter of September 20th, 1783, from the fuperintendant of fi nance, with fundry papers enclosed.

Refolved, That the commiffioner for fettling the marine accounts, govern himself by the refolations of the 11th

July,

July, 1780, and the 13th of June, 1781 in fettling the pay of the officers and men of the navy, and the depreciation thereon.

On the report of a committee confifting of Mr. Howell, Mr. Chafe and Mr. Lee, to whom was referred a letter of 13th January, 1784, from the fuperintendant of finance, on the memorial of James Taylor.

Refolved, That the comptroller of accounts be, and he hereby is authorized and directed, to cause a settlement to be made of the accounts between the United States, and the fecret and commercial committees of Congress, and all others exifting under contra&s made with the faid committees, according to the ufual mode of fettling accounts at the treasury, and to report such settlement to Congress.

WEDNESDAY, MARCH 24, 1784.

Congress affembled-Prefent as yesterday.

On motion of Mr. Fofter, feconded by Mr. Blanchard, Refolved, That the determination of the question on the refolution of the committee, on the letter of the 6th of November, 1783, from the legiflature of New Hampshire, touching the proceedings and fentence of the court of appeals in cafes of capture, on the cafe of the brig Lufannah, be poftponed.

On the report of a committee confifting of Mr. Williainfon, Mr. Read and Mr. Lee, to whom was referred a Jetter of it November 1783, from the fecretary at war, concerning certain dragoons who deferted from SouthCarolina, bringing off fome of the best horfes in the regi inent, and their accoutrements.

Refolved, That in confideration of the former conduct of the dragoons belonging to colonel Baylor's regiment, who deferted on May laft from South Carolina, and that during the time of active and dangerous fervice, they had faithfully discharged their duty, their accounts shall be fettled as thofe of other dragoons, except that they all be charged with the herfes they brought off, at the price the best remaining horfe belonging to the fame corps fold for in South-Carolina, and for their accoutrements,

at what the officer fettling those accounts may find to have been their average value.

Congress took into confideration the report of a com. mittee confifling of Mr. Williamfon, Mr. Gerry, Mr. Til. ton, Mr. Jefferson and Mr. M'Henry, appointed to confider what reductions may be made in the civil lift, and the following paragraph being under debate :

"That the office of chargé des affairs, at the court of Madrid, whofe falary is 4444 dollars, be difcontinued." A motion was made by Mr. Hardy, feconded by Mr, Mercer, That the confideration thereof be poft ponedAnd on the question for poftponing, the yeas and nays being required by Mr. Wadfworth.
