Gilberto Andry los anunciados treinta mil arpanes de tierra planos que ha solicitado, á título de venta, y de que se ha hecho relacion, comprehendidas que están en los siete planos levantados por el ágri mensor Don Vicente Pintado, y en los trece que formó el general Don Carlos Trudeau, y de que se hace espedicion, en particular en la certifica cion relativa, que ambos ministraron los parages baxo los linderos, rumbos y distancias de que se ha hecho referencia que para la constancia, inteligencia y comprehencion se colocaron con este título la certificacion relativa y trece planos dados por el anunciado Don Carlos Trudeau comprehensivo todos los indicados treinta mil arpanes: para que como propios del mencionado Sr. Coronel Dn. Gilberto Andry los posee, cultive y disponga de ellos á su voluntad, como tierras que ba comprado y pagado á la rl. hacienda; y le doy poder para que aprehenda su posecion, y en la que desde luego le pongo y amparo, sin perjuicio de tercero que mejor derecho tenga: con la calidad y condicion de cumplir lo prevenido en la instrucion que sobre tierras formó y pub licó esta intendencia en 17 de Julio de 1799, de que se le advierte para que no se alegue ignorancia. En fé de lo qual mandé despachar el prescute, firmado de mi mano, sellado con él de mis armas y refrendado del infrascripto escribano de rl. hacda. quien como la contadoria gral. tomará la razon. EXHIBIT 3.

A.

I, Juan Ventura Morales, contador of the army, intendent and superintendent ad interim of the province of Florida West, and commissioner for the settlement of accounts of the royal treasury in the province of Louisiana.

Whereas, having personally appeared before this court the colonel of militia, Dn. Gilberto Andry, and proposed to purchase thirty thousands arpents of lands from the royal domains, situated in the district of Baton Rouge, offering to pay the value, one-third cash and the other two-thirds in one year from the date of purchase, and to give the required securities for the payment thereof; in consequence, I ordered that the fiscal be furnished by the secretary with a certified copy of the official letter which I addressed to the commissioners of entrega of this province in regard to a petition of purchase by Dn. Thomas Urquhart, and the indorsement of said commissioners in regard to the subject. This being accomplished, and the approval of the petition by the fiscal having been obtained, I communicated with the governor of Baton Rouge, requesting him to appoint two competent persons of that district as appraisers, who, with two others named by the purchaser in presence of two witnesses, should proceed to the valuation of said land, and at the same time that the surveyor should survey the same. I furthermore ordered that a statement of these proceedings should be returned to me so soon as executed, in order to issue the title deed of the lands, in accordance with the propositions made by the purchaser. I also ordered that a certified copy of the writ by which the petition of Dn. Thomas Urquhart, praying to be placed in possession of fifty thous

and arpents of lands, was referred to the auditor of war, and of the judgement obtained thereon. This done, I ordered the writ of Septemher 28th, ordering a communication to be addressed to the governor of Baton Rouge, including said petition, which was duely served in order to fulfill the requisition of said fiscal and to make the returns of the proceedings to this court; which being complied in accordance with the required formalities of law, resulted in the surveying and valnation of the above-mentioned thirty thousand arpents of land. The surveying was done by the surveyor, Du. Vicente Pintado, in thirteen different sections, as is shown in seven plans which he drew, accompanied by description in writing explanatory of each meas urement and locality of the lands, which will be seen in detail in the plans adjoined to this document. The above-mentioned thirty thous and arpents of land were valued at nine cueldos each, of which I ordered the fiscal to be notified, who, acknowledging receipt of the same, ask that the surveyor-general, Dn. Carlos Trudeau, should record the said in his office; and, furthermore, that the attorney of said Colonel Du. Gilberto Andry should pay into the royal treasury the two thousand seven hundred dollars, value of the lands, including the taxes of media annata and conducion. I furthermore ordered, in accordance with the petition, that the said surveyor, having complied with the order of the court, furnish the colonel with two copies of the thirteen plans, descriptive of as many more sections of land, composing all together the thirty thousand arpents solicited by the above-mentioned colohel, and which was measured at his request. I furthermore certify that, owing to the absence of the colonel, it was represented to this court by bis wife, Da. Maria Taylor, his desire to pay the value of the aforesaid thirty thousand arpents of land in certificates of credit of this contaduria, in place of the first offer made by him. The representation of Da. Maria Taylor was referred to the fiscal, who approved the change in the transaction, and in consequence, by a writ of the 17th instant, I approved of the valuation made of the above-mentioned thirty thousand arpents of land, and ordered that the document be referred to the minister of the royal treasury, and the value to be audited and liquidated in accordance with said solution, and, after said payment being made to the royal treasury as indicated above, that the title-deed be issued according to law. I furthermore certify that the letter of payment issued by the minister on the 22d instant it was shown that the above-mentioned Da. Maria Taylor did pay into the treasury twenty-two thousand two hundred and thirty-seven rs. and seventeen mrs. of silver, twentyone thousand six hundred for the value of the thirty thousand arpents of land, at the rate of nine sueldos each, and six hundred thirty-seven and a half remaining for the two and a half per cent. of media annata, and eighteen per cent. tax of conducion to Spain. Hereby I certify that, after due examination of the thirteen plans extracted from the seven plans drawn up by the surveyor, Pintado, and which are respectively numbered from 1 to 13, aud in regard to the records of the surveyor-general, in his books, it there appears that the first two plans are filed and numbered 1698, and five more are filed and numbered 1699, and five others are filed and numbered 1700, and the remaining one is filed and numbered 1701; and it also appears by the books and data of the archive, and in the explanatory notes accompanying the plans, that each section of land was valued and surveyed for the aforesaid Colonel Da. Gilberto Andry. The plan No. 1 contains four thousand t'ree hundred and seventy-four arpents, situated in the new colony of Santa Helena, on the western side of the stream called Santa Rosalia, gener

ally known as Sandy Creek, situated about nineteen English miles to the southward of the boundary-line; bound on the northern and western side by the domains of the Crown; on the south side the estate of Dn. Carlos Ramos, and on the east by the above mentioned stream, called of Santa Helena. The plan No. 2 contains one thousand and two hundred arpents, situated 24 English miles to the southward of the boundary-line, and about three miles and one-fourth, to No. 14, N, from the confluence of the stream Santa Rosalia with the Comit, bound on the north and south by unoccupied lands, on the east by the estates of Dn. Carlos Ramos, and on the west with the estate of Dn. Thomas Urquhart. Pian No. 3 has four thousand eight hundred arpents, on the western bank of the creek called Bosque Rojo, generally known as Red Wood Creek, commencing at two miles and N. W. of the confluence of such stream with the Comit, bordered on the north and east by unoccupied lands, on the south by the same lands and other lands of the same State, and on the west is bound by Red Wood Creek. Plan No. 4 contains one thousand nine hundred eight, and commences at a mile distance to the west of the confluence of Red Wood Creek, and is bounded on the north by lands of the owner, bounded on the south by lands belonging to Dn. Thomas Urquhart and inoccupied lands, and on the east by Realengos. Plan No. 5, three hundred arpents on the eastern bank of Red Wood Creek, and distant three miles to the westward of the Comit, and two-thirds of a mile from the confluence of the same creek of the river Comit to the N. W.; bound on the north by the same property, and on the south by lands belonging to Dn. Thomas Urquhart and unoccupied lands, and on the east by lands of Dn. Juan Labatut, and on the west by Red Wood Creek. Plan No. 6, nine hun dred fifty-seven arpents on the eastern bank of Red Wood Creek, and fronts at a distance of four and 3 miles to the N. W. of its junction with the Comit; bordered on the north by lands belonging to Juan Bautista Leonard, on the south and the east by lands of the same estate, and on the west by Red Wood Creek. Plan No. 7, three thousand eight hun. dred and sixty, on the western bank of river San Buenaventura, generally known as the Comit, and fronts on this river at a distance of three miles and above its mouth; bounded on the north by unoccupied lands, on the south by the lands of Dn. Juan Bautista Labatut, east by the river Comit, and west by those of the same property. The plan No. 8 includes two thousand five hundred arpents, six miles from Fort Baton Rouge towards E., N. E. on the source of Jones' Creek, bordered on the north and east by unoccupied lands, and on the south by lands of the same property and those of Dn. Juan Bautista Labatut, west by the lands of Du. Thomas Urquhart. Plan No. 9 comprises two thousand three hundred and eighty arpents, at a distance of 74 miles from Fort Baton Rouge, and on the east of the fort; bounded on the north by lands of the same estate and by unoccupied lands, west by lands of Dn. Juan Bautista Labatut, on Jones' Creek. Plan No. 10 comprises two thousand arpents, at a distance of nine miles from Baton Rouge towards the east, and at about 23 miles from river Comit, bordered on the north and east by lands unoccupied, and on the south and west by lands of the same estate. Plan No. 11 contains t'ree thousand one hundred and sixty-nine arpents, distant six miles eastsoutheast of Fort Baton Rouge; bounded on the north by lands of the same owner and those of Dn. Juan Bautista Labatut; east by unoccu pied lands, by the same lands, and partly by those of Dn. Antonio Gras; southwest by Warth Creek and by lands of Juan de Rempart and those of Jonathan Smith. These lands were measured before by

Do. Juan Reynes, and were left over as surplus lands. Plan No. 12 has two thousand arpents, at nine miles and E. & S. E. of Fort Baton Rouge, bounded on the north by lands of the same estate, and on other points of the compass by unoccupied lands. Plan No. 13 has four hundred eighty arpents, at 8 miles distance S. E., E., and is bounded on the north by lands belonging to Isaac Lethrop; on the south by those of José Sharp; on the east by the lands of Dn. Juan Bautista Labatut, and on the west by lands of Dn. Francisco Rivas and Antonio Adam. Therefore, and by virtue of the authority vested in me by our august sovereing, I transfer to the above-mentioned colonel of militia, Dn. Gilberto Andry the aforesaid thirty thousand arpents of land, which he has solicited to purchase, and which has been described in the seven plans surveyed by Dn. Vicente Pintado, and also in the 13 plans formed by the surveyor-general, Dn. Carlos Trudeau; all of which is particularly mentioned in the certificacion relativa, signed by both parties, showing the locality, boundaries, directions, and distances as above described. And for the knowledge of those who it may concern, the certificacion relativa and 13 plans given by the above-mentioned Du. Carlos Trudeau, comprising, altogether, the thirty thousand arpents indicated, is adjoined to this deed. The Colonel Dn. Gilberto Andry, having paid to the royal treasury the value of said lands, I hereby put said colonel in full possession of them, without interfering with the rights of those who may have a better title, and with the condition to observe the landlaws made and published by this intendencia on the 17th of July, 1799. In testimony whereof I hereunto set my hand and seal, and countersigned by the notary of the royal treasury, who, with the contaduriageneral, will take record of this document. Given in N. Orleans the 29th of February, 1804.

Anjourd'hui, deuxième jour de mars de l'année mil hiut cent quatre, la vingt huitième de l'independence américaine, avant midi, pardevant noi, Pierre Pedesclaux, notaire public des Etats Unis d'Amérique, à la Nouvelle-Orleáns, capitale de la Louisiana, fut présente Dame Marie Taylor, épouse du Sieur Gilbert Andry, cidevant colonel commandant les milices de cette ville au nom de Sa Majesté Catholique, le roy d'Espague. La ditte dame démeurant en cette ville, paroisse de Saint Louis, laquelle au nom et comme fondée du pouvoir général sudit Sieur Gilbert Andry, son marie, reeue devant nous, notaire, le sept dé cembre de l'année dernière, mil huit cent trois, a par ces présentes de son bon gré, propre mouvement, et par sa volonté, vendée, cédée, quitté et transporté, avec promesse du garantie de tous troubles, dettes, hipothèques, dons, douanes, évictions et autres empêchements généralement quelconque, même de le faire ratifier par le dit sieur son mari à toute requisition, au sieur Daniel Clark, négociant de cette ditte ville, y demeurant ditte paroisse de Saint Louis, y présent et acceptant pour lui, ses heirs ou ayans cause,trente mille arpens de terre situées dans le district de Baton Rouge, suivant et conformement aux plan qui lui onte été lever par le sieur Charles Trudeau, arpenteur géomètre de cette colonie, les dits plans, au nombre de treize, avec leur numero distinctif et indiquants les joignaus et aboutissans de chaque terre, ainsi que l'endroit ou elle est située, aux quels plans le dit sieur acquéreur devra se con

former; et que nous avons signé et paraphé, ne varietur, avant de les remettre au dit sieur acquéreur. Les dites trente mille arpens de terre vendus telle qu'ils se pouvrairent et comportent, sans en rien reserver ni retenir, et tel qu'en a joui le dit sieur Gilbert Andry, aquel ils appar tiennent pour les avoir aquisées de la real hacienda par titre autentique delivré le vingt neuf février dernier. Lequel titre a été remis par la dite dame Landry au dit nom après avoir été de nous préalablement signé et paraphé, ne varietur. La présente vente faitte et acceptée entre les parties aux clauses et conditions ci-dessus et en outre pour et moyennant le prix et somme de sept mille cinq cents piastres gourdres, que le dit sieur acquéreur a présentement et à vue de nous notaire suissigné comptée et payée en espèces sonnantes du pouvoir mexicaine à la ditte dame Landry au dit nom, que des a prisés et serrées et en est contentée, et en a quittée et quitte la dit sieur acquéreur en faveur duquel elle s'est désistée et separée en sa ditte qualité de tout droit de propriété sur les dits trente mille arpens de terre, circonstances et dépendances, l'en a saisé et revêtu pour par lui enjouir en toute propriété comme de chose lui appartenant dés maintenant et à toujours, et en prendre possession quand bon lui semblera. Car ainsi, &c., renoncant, &c., obligeant, &c., promettant, &c., dont acte et jugé de leur consentement. Fait et passé en notre étude à la Nouvelle-Orléans les jour et an que dessus, en présence des sieur Jean André Michel et de Edwd Étienne Guichard, un chapellière en cette ville, tomoins qui ont ainsi que les parties signé en présence de nous notaire soussigné.
