and fix the quantity so to be delivered. When said commission has made such determination, it shall certify same to the public service commission which shall immediately take such steps with reference thereto and in order to accomplish the transportation thereof, as are now or may be hereafter authorized by law.

10052a6. Price fixed by the federal government.-21. In no event shall any price for coal be fixed in excess of the price established therefor by the federal government or any of its agencies.

10052b6. Food prices, investigation, report.-22. Said commission shall also investigate the high cost of food products and profiteering, hoarding and destroying of food products by wholesalers, retailers, dealers, and individuals engaged in the sale and distribution of food products and make recommendations to the governor for the preparation of a bill to be presented to the consideration of the next general assembly recommending such laws as will prevent said profiteering, hoarding and destroying of food and food products used for human consumption on the part of said wholesalers, retailers, dealers, individuals or distributors of such food or food products.

Section 23 provides that the above act shall be in force from and after its passage.

[Acts July special session 1920, p. 53. In force November 13, 1920.] 10053a. Rights and privileges of soldiers, sailors, their widows and orphans.-1. That soldiers and sailors, and their widows and orphans, of the late war with Germany, and of the war with Spain, and of the war in the Philippine Islands and in the regular service of the United States who are residents of the State of Indiana, shall have and are hereby given all the rights and privileges now held and enjoyed by soldiers and sailors, their widows and orphans, of the late civil war. This section amends section 1, Acts 1919, p. 773.

10053b. Flag commission.-1. The commission appointed by the governor under and by virtue of chapter three (3) of the acts of the Indiana general assembly at its special session for 1908, as continued in the acts of 1911 and 1913, be continued in existence for the purpose of carrying out the provisions of this act. In the event of any vacancy in said commission by death or resignation, the governor of this state shall fill such vacancy, but no person shall be eligible to an appointment as a member of such commission unless he shall have served in the army of the United States either in the civil war, the Spanish-American war, the Philippine insurrection or the war with Germany.

This section amends section 1, Acts 1915, p. 17, not printed in the Supplement

of 1918.

10053c. Superintendent's duties.-2. The commission shall designate one of its members as superintendent, whose duty it shall be to assume general charge of all Indiana battle flags and to prepare all such flags for casing as hereinafter provided. Such superintendent shall likewise have the custody of all battle and organization flags now in the possession of the State of Indiana, or which may hereafter come into the possession of the state, and which were used by any of the military organizations of the State of Indiana in any of the wars or campaigns in which the United States has been engaged, and in which Indiana soldiers, sailors or marines participated. In the preparation of such battle flags for casing, the superintendent shall, so far as possible, see that the name and the branch of the service in which the organization served is attached to the flag; he shall collect data in reference to each such organization or military unit whose flag is now in the possession or may hereafter come into the possession of the commission, and shall place the same on at least one flag or banner of each of such organizations or military units. The commission shall likewise collect Indiana battle flags not now in the possession of the state, the United States or patriotic societies or individuals; they shall reinforce, collect the data for, and otherwise prepare all such battle flags for incasing and they shall collect, systematize and prepare a brief history of each flag and shall index and catalogue the same. The commission shall likewise collect, purchase and procure materials for one sample case, including a blue print. For the purpose of collecting and preparing the necessary data, reinforcing the flags, cleaning the cases and performing other duties prescribed by this act, the commission is hereby authorized to employ and fix the compensation of such employes as may be necessary, and to purchase any and all material of any character whatsoever which may be required in carrying out the provisions of this act.

This section amends section 2, Acts 1905, p. 17.

10053d. Salary of superintendent, expenses.-3. The members of said commission shall receive for their service their necessary traveling expenses in attending any meeting of said commission and the superintendent shall receive his traveling expenses while engaged on any business of the commission and in addition thereto the sum of eighteen hundred dollars ($1,800) per year, which shall be paid at the same time and in the same manner as the compensation of state officers: Provided, That the sum expended for all traveling expenses of the commission under the provisions of this section shall not exceed two hundred dollars ($200) per annum. The members of the commission shall from time to time file with the auditor of state their verified

accounts for such traveling and other expenses and the auditor of state shall thereupon draw his warrants for such amounts respectively upon the treasurer of state.

10053e. Contract for flag cases.

This section 4, Acts 1915, p. 17, not printed in the Supplement of 1918, was repealed by section 10053h, being section 6, Acts 1921, p. 466.

10053f. Flag cases, location and care of.-5. The flag cases already constructed and installed shall remain where they are now assembled in the corridors on the fourth floor of the state house. All flag cases now completed shall be in the custody of the commission and it shall be the duty of the superintendent to have the cases cleaned from time to time as is necessary.

This section amends section 5, Acts 1915, p. 17.

10053g. Appropriation.-6. There is hereby appropriated annually out of the general fund in the state treasury the sum of three thousand dollars ($3,000) out of any funds not otherwise appropriated for the purpose of paying for all labor and materials necessary to prepare such flags for incasing and to place the same in condition as hereinbefore provided, and for clerk or stenographer hire for collecting and typewriting historical data thereon, and for all other expenses provided for in this act.

This section amends section 6, Acts 1915, p. 17.

10053h. Repeal.-6. That section 4 of the above entitled act be and the same is hereby repealed.

This section repeals section 4, Acts 1915, p. 17, being section 10053e.

100531. Title of act amended.-7. The title of the above entitled act be amended to read as follows: An act providing for the preservation, care, reinforcement and custody of the battle flags carried by organizations of Indiana soldiers, sailors or marines in any of the wars and campaigns in which the United States has been engaged and for the collection and preservation of the histories of such flags. This section amends title to act 1915, p. 17.

10053j. Repeal.-8. All laws and parts of laws in conflict herewith are hereby repealed.
