STATE OF NEW YORK-EXECUTIVE CHAMBER In the Matter of the Charges Preferred against N. Benincasa, Notary Public, County of Niagara NOTICE AND SUMMONS

You are hereby notified that charges have been preferred against you by the State Industrial Commission, through its First Assistant Counsel, Frederick H. Cunningham, asking that you be removed from the office of Notary Public in and for the County of Niagara; a copy of said charges hereto annexed, are herewith served upon you.

I hereby fix the twenty-seventh day of December, 1917, at twelve o'clock Noon, in the Executive Chamber in the City of Albany, as the day on or before which your answer to said charges shall be filed with me, and you are further notified that at that time, or on such later day or days as may be appointed by me, you will be afforded an opportunity of being heard in your defense.

IN WITNESS WHEREOF, I have hereunto set my

hand and affixed the Privy Seal of the State, [L. S.] at the Capitol in the City of Albany, this tenth day of December in the year of our Lord one thousand nine hundred and seventeen.

APPOINTMENT OF COMMISSIONER

STATE OF NEW YORK-EXECUTIVE CHAMBER In the Matter of the Charges Preferred against N. Benincasa, Notary Public, County of Niagara

APPOINTMENT OF COMMISSIONER

Charges having been filed with me by the State Industrial Commission of the State of New York, by its representative, Frederick H. Cunningham, First Assistant Counsel for the said Commission, verified December 3rd, 1917, against N. Benincasca, a notary public of Niagara county, with a prayer that he be removed from his office of notary public in and for the county of Niagara; and

A copy of such charges having been given to said N. Benincasa; and he having made answer thereto;

Now, THEREFORE, pursuant to the statute in such case made and provided, I do hereby appoint Honorable Norman D. Fish, County Judge of the County of Niagara, to take evidence as to the truth of said charges;

And I hereby direct said County Judge to report to me said evidence and his findings of the material facts deemed by him to be established in connection with said charges, together with his conclusions thereon.

GIVEN under my hand and the Privy Seal of the State at the Capitol in the City of Albany [L. S.] this twelfth day of March in the year of our Lord one thousand nine hundred and eighteen.

DISMISSAL OF CHARGES

STATE OF NEW YORK-EXECUTIVE CHAMBER

In the Matter of the Charges Preferred against N. Benincasa, Notary Public, County of Niagara

DISMISSAL OF CHARGES

Charges of misconduct in office having been preferred against N. Benincasa, Notary Public, Niagara County, by the State Industrial Commission, through its first Assistant Counsel, Frederick H. Cunningham, and a copy of said charges having been given to said N. Benincasa on December 10th, 1917, and the said N. Benincasa having made answer thereto, and the Hon. Norman D. Fish having been appointed by me Commissioner to take evidence as to the truth of said charges, and to make report, and the said Commissioner having taken the evidence and made a report recommending that the said charges be dismissed.

Now after consideration of the said charges, the evidence pertinent thereto, and the said report, it is hereby

ORDERED, that the said charges against N. Benincasa be, and the same hereby are, dismissed.

GIVEN under my hand and the Privy Seal of the

State at the Capitol in the city of Albany [L. s.] this fifteenth day of June, in the year of our Lord, one thousand nine hundred and eighteen.
