The Street Commissioner to whom was referred the Petition of Abraham Herring and Stephen N Bayard to shut up Amity Lane reported against the same as follows

The Street Commissioner to whom was referred the Petition of Abraham Herring and Stephen N Bayard setting forth that they are severally owners of certain peices or portions of Ground being a part of what is called and known as Amity Lane in the now Ninth Ward of this City-and as that Opening or Lane is not wanted for a highway and thoroughfare, they pray the Corporation of this City to direct it to be closed

From all the circumstances of the Case the Street Commissioner is induced to report as follows

It appears that Amity Lane was Originally laid out by the Joint consent of the proprietors of the Herring and Bayard farms for the Convenience of such of them as had their allotments remote from Broadway, or any public Road, and has not been used as a Public Road or High Way or acknowledged as such the petitioners themselves state "That the highway so created under the agreement of your petitioners, and called Amity Lane has never been ceded to, nor received by the Common Council, for a Public Road, Street, or Avenue-That the purposes and uses expressed and implied in the agree

ment of your petitioners to devote the said lots or parcels, of land belonging to them as a High way have long since ceased and can never recur"

[17] It further appears that the Petitioners have long since sold all the Lots adjoining to and lying on Amity Lane bounding them thereon, and giving the purchasers a right of way therein

From the foregoing statement the Street Commissioner is induced to submit the following opinion as the result of the enquiry Viz That the way called Amity Lane never has been a Public Highway Street or Lane and of course the Corporation of this City are not vested with the power under any statute to direct the same to be closed that the fee simple is in the Original owners of the Soil and the right of way is in the owners of the Lots bounded thereon and that the petitioners have no remedy, but in a compromise with the said owners

All which is respectfully submitted
