Notification by the Government of Bombay, Political Department, dated the

6th May, 1884, Bombay Government Gazette, 1884, Part I., page 369. No. 3308.— The following Notification by the Government of India is republished :

LEGISLATIVE DEPARTMENT,

Simla, the 23rd April, 1884. No. 12.—Whereas by Resolution(a) passed by the Secretary for India in Council on the 3rd day of October, 1872, the provisions of the 33rd of Victoria, Chapter 3, Section 1, were declared applicable to the Districts of Kohistan, Johi, Nasirabad, Sujawal, Sehwanı, Kakkar, Kambar, Jacobabad, Thul and Kasmor, bordering on the Frontier of Sind from Mithi on the Indus to the sea west of Karachi.

And whereas the Governor of Bombay in Council has proposed to the Governor General in Council a draft of the following Regulation, together with the reasons for proposing the same ; and whereas the Governor General in Council has taken such draft and reasons into consideration and has approved of such draft, and the same has received the Governor General's assent;

In pursuance of the direction contained in the said Section, the said Regulation is now published in the Gazette of India :-

REGULATION No. II. OF 1884.
A Regulation to amend the Sind Frontier Regulation, 1872.

Whereas it is expedient to empower District Officers on the Sind Frontier to punish persons convicted of certain offences by Courts of Elders with imprisonment for a term which may extend to two years, in default of payment of fine, and to dispose in inanner hereinafter provided of sums realized on account of fines; It is hereby enacted as follows :

1. (1) This Regulation may be called the Short title.

Sind Frontier Regulation, 1883; and
Commencement.

(2) It shall come into force at once.

2. For the last thirty-three words of Section 6 Amendment of Section 6 of Siud

of the Sind Frontier Regulation, 1872, the following Frontier Regulation, 1872.

shall be substituted, namely :• The Collector and Magistrate shall cause the decision of the Elders, in so far only as it extends to the punishment of the offender with fine, to be carried into effect as if it were a sentence of a Court, and may direct that, in default of payment of the fine, the offender shall suffer imprisonment of either description as defined in the Indian Penal Code for a term which may extend to two years.

• Provided that such imprisonment shall terminate whenever the full amount of the fine is either paid or levied by process of law.

“The Collector and Magistrate may also, when causing the decision of the Elders to be carried into effect, order the whole or any part of the fine recovered to be applied

'(a) in defraying expenses properly incurred in the prosecution; and
(6) in compensation for the injury caused by the offence committed, where,

in the opinion of the Collector and Magistrate such injury can be

compensated by money. 'At the time of awarding compensation in any subsequent Civil Suit relating to the same matter the Court shall take into account any sum paid or recovered as compensation under the last foregoing paragraph.'
