WHEREAS it is enacted by the Indian Ports Act, 1875, section thirtyeight, that no vessel of the burden of two hundred tons or upwards shall be moved in any port to which that section has been specially extended without 334 having a Pilot, Harbour-master, or Assistant of the Master Attendant or Harbour-master on board; and that no vessel of any burden less than two hundred tons and exceeding one hundred tons shall be moved in any such port without having on board a Pilot, Harbour-master, or Assistant of the Master Attendant or Harbour-master, unless authority in writing so to do has been obtained from the Conservator or some officer empowered by him to give such authority; And whereas it is expedient to exempt Native vessels when moved in the Port of Bombay from the provisions of the recited section; And whereas it is also expedient to exempt pleasure-yachts throughout British India from the levy of port-dues; "Nothing in this section shall apply to Native vessels when they are moved in the Port of Bombay. "If any question arises as to whether any vessel is a Native vessel within the meaning of this section, the decision thereon of such authority as the Governor of Bombay in Council may, from time to time, appoint in this behalf shall be conclusive."
