May he produce all proofs in his favour?

By what may a man, guilty of some crime be subjected to punishment?

May the Legislature make any law, that shall subject a person to a capital punishment?

In criminal prosecutions what is one of the greatest securities of the life, liberty and property of the citizen?

Are unreasonable searches and seizures to be countenanced?

How must all warrants of this kind be previously supported, and what must accompany them?

In what cases, and with what formalities ought a warrant to be issued ?

In all controversies have the parties a right to trial by jury? How is this method of procedure to be held?

Ought the liberty of the press to be restrained?

Why not?

What have the people a right to do for the common defence?

May armies be maintained in time of peace?

Is the military power in subordination to any other? What is absolutely necessary to preserve the advantages of liberty, and to maintain a free government?

Ought the people to have particular regard to moral character in the choice of officers and representatives?

What have they a right to require of their law-givers and magistrates?

Have they a right to assemble, and consult upon the common good?

How may they publicly make known their desires?

Who have the power of suspending laws, or the execution of them?

What is very essential to the rights of the people?

May the members of either house exercise this right without control?

For what purpose ought the Legislature frequently to assemble?

Can a charge, tax, or duty, be established, or levied upon the people under any pretext whatever?

What laws are unjust and oppressive ?

May the Legislature ever declare a subject guilty of treason or felony?

What does the Constitution say respecting bail, fines and punishments?

May a soldier, or soldiers be quartered in any house?
What is to be done in time of war?

Are all subjected to law martial?

What is essential to, the preservation of the rights of every individual, his life, liberty, property and character? How has every citizen a right to be tried?

How long do the Judges of the Supreme Court hold their offices?

Is it sound policy, that they should have honorable salaries? In the government of this Commonwealth may one depart ment ever exercise the powers of another?

Why not?

FRAME OF GOVERNMENT.

When did the people of Massachusetts agree to form themselves into a Free, Sovereign and Independent State ?* By what name?

CHAPTER I.

LEGISLATIVE POWER.

GENERAL COURT.

In the department of legislation, how many branches?

Who compose them?

How often shall the legislative body assemble?

When ?

When shall they dissolve and be dissolved?

What are they styled?

How can a bill, or resolve of the Senate, or House of

Representatives become a law and have force as such? It shall be laid before the force of law.

In all such cases how shall the votes of both houses be determined?

What more must be done?

What power and authority have the General Court? To erect and constitute of execution thereupon. Does the General Court grant to other courts power and authority to administer oaths or affirmations ?

For what purpose?

What further power and authority has the General Court? To make, ordain and within the same.

For what purpose shall the valuation of estates be taken? How often?

SENATE.

How often shall Counsellors and Senators be elected?
How large a number?

By whom are they chosen?

Who may divide the Commonwealth into Districts and assign the number to be elected by each District?

In determining the number each District may elect, to what must the General Court have particular regard?

When a new division is made, who is to make known to the inhabitants the limits of each District, and the number to be chosen by them?

Into how many Districts must the Commonwealth be divided?

How many Senators may be chosen in one District? Who compose the first branch of the Legislature? How, and by whom are they to be chosen? There shall be a meeting is an inhabitant.

How shall it be determined who is an inhabitant?

Who shall impartially preside at such meetings?

On such occasions what duties devolve upon the Selectmen, the Town Clerk, and afterward, upon the Sheriff of the county? They shall receive

in May.

That there may be a due convention of Senators on the last Wednesday in May, what shall the Governor with five of the Council do?

Who shall be final Judge of elections, returns and qualifi cations of members of the first branch of the Legislature? On what day shall the Senate annually determine and declare, who are elected by each District ?

In case the full number should not be elected by a majority of voters, how shall the deficiency be supplied? The members of the House of the Commonwealth. How shall vacancies arising by death, removal out of the State, or otherwise, be supplied?

To qualify a man to be elected a Senator how much property must he have within this Commonwealth?

How long must he be an inhabitant immediately preceding

his election!

In what part of the State must he reside?

Have the Senate power to adjourn themselves?

Who choose the President, appoint officers, and determine the rules of proceedings in the Senate?

In any case, shall the Senate of itself be a court?
For what purpose?

How far shall their judgment extend?

Is the party convicted liable to another trial?

How many members shall constitute a quorum for doing business?

HOUSE OF REPRESENTATIVES.

In the Legislature of this Commonwealth shall there be an annual representation of the people?

Founded upon what principle?

That an incorporated town may elect one representative, how many ratable polls must be in it?

How many, that it may elect two Representatives?
How many that it may elect three?

What is the mean increasing number for every additional Representative ?

Is there any exception to this rule?

Can a town of this description, incorporated since the adoption of the Constitution have the same privilege?

In what case may towns be fined by the House of Representatives?

For how much travel does the government pay each member?

How shall the members of the House of Representatives be chosen?

What is requisite to qualify a man to be elected a Representative?

What if he should cease to be thus qualified?

When shall the members of the House be annually chosen? What body of men is the grand inquest of this Commonwealth?

By what body of men shall all impeachments, made by the House, be heard and tried?

Where shall all money bills originate?

Who may propose or concur with amendments?

Have the House of Representatives power to adjourn themselves?

How many members of the House shall constitute a quorum for doing business?

What shall the House of Representatives be? The Judge, &c.

What shall they do? Choose, &c.

Whom have they authority to punish by imprisonment? Every person, not a member, who of the House. When shall the members of the House not be arrested, or held to bail on mean process?

In like cases shall the Senate have the same powers? Shall the Governor and Council have the same authority? How long may a person be imprisoned for doing harm, or showing disrespect to the General Court?

In their own way, may the Senate and House try and determine all cases, where their rights and privileges are concerned?
