MONDAY, February 3d, 1919.

At 8 o'clock P. M. the Senate met.

The session was opened with prayer by the Rev. Edward G. Read, D.D., of Plainfield.

Under the direction of the President, the Secretary called the Senate, when the following Senators appeared and answered to their names.

Messrs. Ackerson, Allen, Bright, Brown, Case, Fithian, Haines, Hammond, Mackay, Martens, Pilgrim, Smith, Sturgess, Wells, Whitney-15.

Senate was called to order by Senator J. Hampton Fithian. On motion of Mr. Case, the reading of the Minutes of the Journal of January 27th and 28th was dispensed with.

Mr. Pilgrim, on leave, introduced

Senate Bill No. 45, entitled "An act to amend an act entitled 'An act concerning trust companies'" (Revision of 1899),

Which was read for the first time by its title, ordered to have a second reading, and referred to the Committee on Banks and Insurance.

The same Senator, on leave, introduced

Senate Bill No. 46, entitled "An act to amend an act entitled 'An act to authorize cities of the first class of this State to make annual appropriations to incorporated dental associations of this State conducting and maintaining dental clinics in such cities for the free treatment of indigent children,'" approved April ninth, one thousand nine hundred and thirteen,

Which was read for the first time by its title, ordered to have a second reading, and referred to the Committee on Municipal Corporations.

The same Senator, on leave, introduced

Senate Bill No. 47, entitled "A supplement to an act entitled 'An act for the punishment of crimes (Revision of 1898)," approved June fourteenth, one thousand eight hundred and ninety-eight,

Senate Bill No. 55, entitled "A supplement to an act entitled 'An act for the assessment and collection of taxes,'" approved March fourth, one thousand nine hundred and eighteen,'

Senate Bill No. 56, entitled "An act prohibiting any person or corporation from erecting, setting, operating or maintaining any fish pound net in any of the waters of the Atlantic ocean, Sandy Hook bay, or Raritan bay, without first obtaining a license for such purpose from the Board of Fish and Game Commissioners. of this State, and providing a penalty for the violation thereof,"

Which was read for the first time by its title, ordered to have a second reading, and referred to the Committee on Game and Fisheries.

Mr. Wells, on leave, introduced

Senate Bill No. 57, entitled "A supplement to an act entitled 'An act concerning auto busses, commonly called jitneys, and their operation in cities,' approved March seventeenth, one thousand nine hundred and sixteen,

Which was read for the first time by its title, ordered to have a second reading, and referred to the Committee on Highways. The following communications were received from the President of the Senate, Mr. Runyon :

Gentlemen of the Senate:

February 3d, 1919.

If by reason of absence or other cause, Senator David G. Conrad, of Ocean county, heretofore designated and appointed by me to perform the duties of the Chair on Monday, February 3d, 1919, shall fail so to do, then and in such event I hereby designate and appoint Senator J. Hampton Fithian, of Cumberland county. to perform such duties of the Chair during the whole or any part of the session of said Senate appointed to be held on said Monday, February 3d, 1919.

Gentlemen of the Senate:

It is with deep regret that I announce the resignation of Senator Collins B. Allen, of Salem county, as a member of the Committee on Appropriations, and while I have not had the opportunity of consulting and ascertaining his wishes, I do, nevertheless, hereby appoint Senator Joshua C. Haines, of Camden county, as a member of said committee to fill the vacancy caused by the resignation of Senator Allen. Very sincerely yours,

Gentlemen of the Senate:

Since Tuesday last I have been ill, with what started out to be the grippe and which later developed into influenza and bronchialpneumonia, therefore it will be impossible for me to attend this week's sessions of the New Jersey Senate.

I am sending to Mr. Albright the necessary designation of Senators to perform the duties of the Chair, both for to-night's session and for the session which will probably be held to

morrow.

I fully expect to be present at next week's sessions.

The above communications were received and read, and ordered spread in full upon the Minutes of the Journal.

Mr. Case offered the following resolution, which was read and adopted:

Resolved, That when the Senate adjourn it be to meet on Wednesday morning at II o'clock, and that when it then adjourn it meet on Friday morning at II o'clock, and that when it then adjourn it be to meet on Monday evening at 8 o'clock.

Mr. Case made the following nominations.

Mr. Case offered in nomination the following additional officers and moved their election to their respective positions:

Assistant Secretary of the Senate-Howard Eastwood, of the county of Burlington.

Assistant Sergeant-at-Arms-Sherry Wallace, of the county of Cumberland.

Assistant Bill Clerk-Luke F. Carll, of the county of Salem. In the affirmative were—

Messrs. Ackerson, Allen, Barber, Bright, Brown, Case, Conrad, Fithian, Haines, Hammond, Mackay, Pilgrim, Smith, Sturgess, Wells, Whitney-16.

In the negative—None.

On motion of Mr. Case, the Senate proceeded to the consideration of Executive business, on the conclusion of which, and,

Under the direction of the President, the Secretary called the Senate, when the following Senators appeared and answered the call: Messrs. Ackerson, Allen, Barber, Bright, Brown, Case, Conrad, Fithian, Haines, Hammond, Mackay, Martens, Pilgrim, Smith, Sturgess, Wells, Whitney-17.

Mr. Case moved to reconsider the resolution of adjournment, which was agreed to.

Mr. Case offered the following resolution, which was read and adopted:

Resolved, That when the Senate adjourn it be to meet on Thursday morning, at 11 o'clock, and that when it then adjourn it be to meet on Saturday morning at II o'clock, and that when it then adjourn it be to meet on Tuesday, February 11th, at II o'clock A. M.

A message was received from the Governor, by the hands of Mr. Croasdale, his Secretary, endorsed "Nominations."
