preserved by such Clerk. Each Judge shall transmit to the state printer a copy of every appointment of Circuits made by him, which shall be published in the state paper, pursuant to law.

These Courts may direct their writs into any of the counties of the state, as occasion may require.

The COUNTY CLERKS in the respective counties, are ex officio Clerks of the Courts of Oyer and Terminer.

COURTS OF COMMON PLEAS AND GENERAL SESSIONS OF THE PEACE.

The JUDGES of the Courts of Common Pleas and General Sessions of the Peace, are appointed by the Senate, on the nomination of the Governor, and hold their offices for five years.

DISTRICT ATTORNEYS are appointed by the Courts of Common Pleas, and hold their offices for three years.

The SHERIFFS and CLERKS of the several counties, including the Register and Clerk of the city of NewYork, are chosen by the people, and hold their offices for three years.

The COUNTY CLERKS are ex-officio Clerks of the Courts of Common Pleas and General Sessions of the Peace, in their respective counties, and are the REGISTERS OF

DEEDS.

SHERIFFS are ineligible for the next three years succeeding the termination of their offices.

CLERKS OF COURTS, other than County Clerks, are appointed by the Courts of which they respectively are Clerks, and hold their offices for three years..

COUNTY TREASURERS are appointed by the Board of Supervisors in each county, and hold their offices during the pleasure of the Board appointing them.

SURROGATES 66 are appointed in the manner prescribed by the constitution for judicial officers other than Justices of the Peace," and hold their offices for four years. They have no clerks known to the laws of the state. They hold their courts at such times and places as they may direct, and certify their own proceedings. In March, 1823, after the adoption of the constitution,

an act was passed abolishing the Court of Probates, and granting the powers thereof to Surrogates.

CORONERS, not exceeding four in each county, are elected in the same manner as Sheriffs, and hold their offices for three years.

The stated terms of the Courts of Common Pleas and General Sessions of the Peace, in all the counties in the state, are regulated by statute. In all cases not special. ly provided for, they are holden at the Court-Houses in . the several counties, and are holden at the same term's unless otherwise designated by law.

ALBANY COUNTY.

Constituted about the year 1664.

In 1825 its popu

STATED TERMS.-Third Tuesday of March, and the second Tuesdays of June, September, and December. But no trial can be had in any criminal prosecution du ring the first week of the said terms.

The Court of Common Pleas, for the county of Albany, may be held by the first Judge of the County Court of the said county, either alone, or with one or more of the other Judges; but it is the special duty of the First Judge to hold the said Court.

JUSTICES OF THE PRACE.

The first election of Justices of the Peace, by the people, since the amendment to the constitution, was holden in November, 1827, and since that period they have been regularly chosen at the Fall election in each year.

But in conformity with the amendment to the constitution, and by virtue of a law enacted at the last session of the legislature, Justices of the Peace are hereafter to be elected by the people of the several towns in the state, at their annual town meetings.

Each town is entitled to four Justices of the Peace, who hold their offices for four years, except when elected to fill a vacancy. They are, immediately after their election, divided, by lot, into four classes. The term of the first class expires at the end of one year; the term of the second class at the end of two years; the term of the third class at the end of three years; and the term of the fourth class at the end of four years, succeeding such election.

Justices of the Peace have jurisdiction of

1. Actions of debt, covenant, and assumpsit, wherein the debt, or balance due, or the damages claimed, shall not exceed fifty dollars.

2. Actions of trespass, and trespass on the case, for injuries to persons, or to real or personal property, wherein the damages claimed shall not exceed fifty dollars.

3. All actions for any penalty not exceeding fifty dollars, given by any statute of this state.

4. All actions commenced by attachment of property, as provided in the statute, wherein the debt or damages claimed shall not exceed one hundred dollars. And,

5. To take and enter judgment on the confession of a defendant, where the amount confessed shall not exceed two hundred and fifty dollars.

But no Justice of the Peace shall have cognizance of any action,

1. Wherein the people of this state shall be named as

a party, excepting suits for penalties not exceeding fifty dollars.

2. Nor where the title to land shall in any wise come in question, as provided in the statute.

3. Nor of any action of assault and battery, false im prisonment, slander, or malicious prosecution.

4. Nor of any matters of account, where the sum total of the accounts of both parties, proved to the satisfaction of the Justice, shall exceed four hundred and fifty dollars.

5. Nor of any actions against executors or adminis trators, as such, or against corporations.
