MEMORIAL DAY.

MEMORIAL MONUMENTS.

Note. By L. 1886, c. 466, commissioners were appointed to determine the positions and movements, at the battle of Gettysburg, of the several military organizations of this state that took part in that battle, and to report to the next session of the legislature the action of such committee. By L. 1887, c. 269, the commission was directed to erect certain monuments to mark the positions of the various New York regiments, and do the other necessary matters connected therewith. Further appropriations for this subject were made by L. 1891, c. 302, pp. 596, 602; L. 1892, c. 356, pp. 743, 749, and L. 1893, c. 726, p. 1813.

By L. 1893, c. 726, a like commission was constituted to erect monuments on the battlefields of Wauhatchie, Lookout Mountain, Missionary Ridge, Tennessee, and Ringgold, Georgia, or about Chattanooga, Tennessee. This second commission was continued by L. 1894, c. 371, as am'd by L. 1896, c. 189, and the two commissions were consolidated by L. 1895, c. 317. The foregoing acts, excepting the following sections, are omitted as temporary.

It shall be the duty of the governor, from time to time, as he shall deem proper, at least once in every three years, to cause to be inspected all the monuments and memorials which shall be erected under this act, and the grounds and avenues secured therefor, and to examine and inquire into the means employed for their protection and preservation, and report their condition, with such facts in relation thereto as he may deem proper, to the legislature. L. 1894, c. 371, § 10.

In case of the resignation, refusal to serve, death or inability of either of said commissioners to perform the duties required, the governor shall fill the vacancy by appointment. Id., § 11.

MESSENGER BOYS.

1 Penalty for sending messenger boys to certain places. A corporation or person employing messenger boys who:

1. Knowingly places or permits to remain in a disorderly house, or in an unlicensed saloon, inn, tavern or other unlicensed place where malt or spirituous liquors or wines are sold, any instrument or device by which communication may be had between such disorderly house, saloon, inn, tavern or unlicensed place, and any office or place of business of such corporation or person; or

2. Knowingly sends or permits any person to send any messenger boy to any disorderly house, unlicensed saloon, inn, tavern, or other unlicensed place, where malt or spirituous liquors or wines are sold on any errand or business whatsoever except to deliver telegrams at the door of such house, is guilty of a misdemeanor, and incurs a penalty of fifty dollars to be recovered by the district attorney. Pen. Code, § 292a, added L. 1893, c. 692.
