11 Former commissioners, etc., may be prosecuted. Be it enacted by the people of the State of New York, represented in Senate and Assembly, That it shall and may be lawful for the supervisor and commissioner of any town, authorised to be chosen by the first section of the act, passed April fourth, one thousand eight hundred and seven, entitled "An act relative to the lots of land, reserved for the support of the gospel and schools, in the counties of Onondaga, Cayuga and Seneca," to commence and prosecute in and by the name and style of the commissioners of the public lot of the town to which they respectively belong, any suit, against any of their predecessors in office, or against any other person or persons, to recover any debt, dues or demand, of right due to the supervisor and commissioner or commissioners of such public lot; and no such suit shall abate by the death, resignation or removal from office of the said supervisor and commissioner, or either of them, but the same shall and may be prosecuted to judgment and execution, by their successors in office. L. 1819, c. 239, § 1.

12 Moneys, how apportioned. And be it further enacted, That all moneys now due or hereafter to become due, and which shall have come into the hands of the aforesaid commissioners of public lots, and have not been applied and paid over to religious societies, shall be apportioned among the several school districts in the several towns in the aforementioned counties, anything in the acts heretofore passed to the contrary notwithstanding. Id., § 2.

13 In Tompkins county. And be it further enacted That the authority hereby given to the supervisor and commissioners aforesaid, be and are hereby given to the supervisors and commissioners of the public lots in the several towns in the county of Tompkins. Id., § 3.

14 Trustees may sell gospel and school lots in military tract. Be it enacted by the People of the State of New York, represented in Senate and Assembly,That it shall be lawful for the trustees of any gospel and school lot who now are or hereafter may be appointed in any town or towns in the military tract in pursuance of any law of this state to sell the said lots belonging to their respective towns upon such credit as to them shall appear most for the interest of their respective towns and to receive payment for the same whenever they shall think proper. L. 1826, c. 30, § 1.

15 Investing moneys; applying income.

And be it further enacted, That it shall be the duty of the said trustees at all times to keep the principal monies realised from the sale of said lots invested in loans secured by bond and mortgage upon unincumbered real estate to double the value of the mortgage money. And for that purpose it shall be lawful for the said trustees, as often as it may become necessary to loan the said monies upon such mortgage security, to purchase in the mortgaged premises upon any foreclosure thereof, and from time to time to loan any monies, and hold dispose of and convey any lands or tenements which may become vested in them in pursuance of their duties as such trustees; Provided, That the said trustees shall always take security by bond and mortgage, for any loans made or for the purchase monies due for lands sold by them, And provided also That the rents and profits of the lands so held by the said trustees and the interest of the monies arising from the sale thereof, shall always be applied by the said trustees according to the provisions of the act hereby amended, unless otherwise specially provided for by law. Id., § 2.

16 Trustees to give bonds. And be it further enacted, That the trustees of any of the said lots hereafter to be appointed shall before they enter upon the duties of their office execute a bond to the supervisors of their respective towns in such penalty and with such sureties as the said supervisors shall approve conditioned for the faithful discharge of the trust reposed in them. Id., § 3.

Supervisor in place of trustees. The office of trustees of the gospel and school lots in the several towns in this state, is hereby abolished; and the powers

Note.-1 R. S. 497, §§ 1, 2, incorporated the trustees of gospel and school lots, and required them to give bonds to the supervisor. The office of trustee was abolished and the trustees' powers and duties were transferred to the town superintendent by L. 1846, c. 186. L. 1856, c. 179, again transferred those powers and duties to the supervisor. For the present state of the law on this subject see Consolidated School Law, $ 46.

Powers and duties. The trustees, besides the ordinary powers of a corporation, shall have power, and it shall be their duty,

1. To take and hold possession of the gospel and school lot of their town:

2. To lease the same for such time not exceeding twenty-one years, and upon. such conditions as they shall deem expedient:

3. To sell the same with the advice and consent of the inhabitants of the town, in town-meeting assembled, for such price and upon such terms of credit as shall appear to them most advantageous:

4. To invest the proceeds of such sales in loans, secured by bond and mortgage upon unincumbered real property of the value of double the amount loaned: 5. To purchase the property so mortgaged upon a foreclosure, and to hold and convey the property so purchased whenever it shall become necessary:

6. To re-loan the amount of such loans repaid to them, upon the like security: 7. To apply the rents and profits of such lots, and the interest of the money arising from the sale thereof, to the support of the gospel and schools, or either, as may be provided by law, in such manner as shall be thus provided:

To render a just and true account of the proceeds of the sales and the interest on the loans thereof, and of the rents and profits of such gospel and school lots, and of the expenditure and appropriation thereof, on the last Tuesday next preceding the annual town-meeting in each year, to the board of auditors of the accounts of other town officers:

9. To deliver over to their successors in office, all books, papers and securities relating to the same, at the expiration of their respective offices: and,

10. To take therefor, a receipt, which shall be filed in the clerk's office of the town. 1 R. S. 498, § 3.

19 Auditing accounts. The board of auditors in each town, shall annually report the state of the accounts of the trustees* of the gospel and school lots in that town, to the inhabitants thereof, at their annual town-meeting. Id., § 4. 20 Sale and apportionment, when town divided. Whenever a town having lands assigned to it for the support of the gospel or of schools, shall be divided into two or more towns, or shall be altered in its limits by the annexing of a part of its territory to another town or towns, such lands shall be sold by the trustees* of the town, in which such lands were included immediately before such division or alteration; and the proceeds thereof, shall be apportioned between the towns interested therein, in the same manner as the other public monies of towns, so divided or altered, are apportioned. Id., § 5.

21 Same: proceeds of sale. The shares of such monies, to which the towns shall be respectively entitled, shall be paid to the trustees* of the gospel and school lots of the respective towns, and shall thereafter be subject to the provisions of this title. 1 R. S. 499, § 6.

22 Same. If in either of such towns, trustees of gospel and school lots shall not have been chosen, or there be none in office, the share of such town shall be paid to the supervisor; and the town, at its next annual town-meeting, and annually thereafter, shall choose such trustees in the same manner as if gospel and

school lots had originally been assigned to it; which trustees shall have charge of the monies so paid to the supervisor, and shall be subject to all the duties and liabilities, and possess all the powers imposed or conferred in this title.* 1 R. S. 499,

23 It shall be lawful for the supervisor of any town having money arising from the sale of gospel lands, and known as gospel funds, to apportion such among the several school districts of his respective town as hereinafter provided. L. 1895, c. 232, § 1.

24 Any town having a gospel fund of five hundred dollars or less may apportion such fund with the consent and approval of a majority of the town board of such town. Id., § 2.

25 Any town having a gospel fund of more than five hundred dollars may apportion such fund in like manner by a vote at any annual or special town meeting. Id., § 3.

26 Where such apportionment is made, the supervisor shall pay to the trustees of the several school districts of his town its pro rata share according to the aggregate school attendance of each school district in the preceding year. Id., § 4.

27 The trustees of such school districts shall execute and file with the supervisor of such town a bond of twice the amount of such apportionment, with sufficient sureties, to be approved by such supervisor. Id., § 5.

28 Such trustees, upon the receipt of such money, shall apply the same for such purpose as the school district in annual or special meeting shall decide. Id., § 6.
