FELONIES.

Punishment of felonies when not fixed by statute. A person convicted of a crime declared to be a felony, for which no other punishment is specially prescribed by this code, or by any other statutory provision in force at the time of the conviction and sentence, is punishable by imprisonment for not more than seven years, or by a fine of not more than one thousand dollars, or by both. Note.

In the case of the People vs. Lyons, 99 N. Y. 210, the court of appeals held that the maximum of the punishment fixed by the statute, and not that actually inflicted by the court, determined whether the crime was a felony or a misdemeanor. The above-mentioned rule has, therefore, been followed in making up the enumeration of felonies given below, as well as in the enumeration of misdemeanors given under that heading. Owing to the extremely loose way in which some of the acts are drawn, it has been very difficult to determine in some cases whether a particular crime was a felony or a misdemeanor. Enumerated.

FERRIES.

1. Maintains a ferry for profit or hire upon any of the waters of this state without authority of law; or,

2. Having entered into a recognizance to keep or maintain a ferry, violates the condition of such recognizance; is guilty of a misdemeanor. Where such ferry is upon waters dividing two counties, the offender may be prosecuted in either county. Pen. Code, § 415, as am'd L. 1892, c. 692.

2 Penalty for neglect to post schedule of ferry rates. A person, corporation or association operating any ferry in this state, or between this state and any other state, operating from or to a city of five hundred thousand inhabitants or over,

posting a false schedule of ferry rates, or neglecting to post in a conspicuous and accessible place in each of its ferry-houses, in plain view of the passengers, a schedule, plainly printed in the English language, of the rates of ferriage charged thereon and authorized by law to be charged for ferriage over such ferry, is guilty of a misdemeanor. Pen. Code, § 415a, added by L. 1893, c. 692.
