"SEC. 6. Each political party for which the name of a

2 presidential candidate shall have been determined pursuant

3 to this article shall nominate a candidate for Vice President,

4 who, when chosen, shall be the official candidate of such

5

party for Vice President throughout the United States. No 6 person constitutionally ineligible for the office of President

7 shall be eligible for nomination as a candidate for the office 8 of Vice President of the United States.

"The candidate of each political party for President shall 10 certify forthwith to the chief executive of each State and 11 the District of Columbia the name of the person chosen by 12 that party as its official candidate for Vice President.

"SEC. 7. In the event of the death or resignation or dis14 qualification of the official candidate of any political party for 15 President, the person nominated by such political party for 16 Vice President shall resign the vice-presidential nomination 17 and shall be the official candidate of such party for President. 18 In the event of the deaths or resignations or disqualifications 19 of the official candidate of any political party for President. 20 and Vice President, or in the event of the death or resignation of the official candidate of any political party for Vice 22 President, a national committee of such party shall designate 23 such candidate or candidates, who shall then be deemed the 24 official candidate or candidates of such party, but in choosing such candidate or candidates the vote shall be taken by

1 States, the delegation from each State having one vote. A 2 quorum for such purposes shall consist of a delegate or dele3 gates from two-thirds of the several States, and a majority 4 of all States shall be necessary to a choice.

"Whenever a substitute candidate of a political party for

6 President or Vice President is designated by or chosen under 7 this section, the chairman of the national committee of that 8 party shall certify forthwith to the chief executive of each 9 State and the District of Columbia the name of such candi10 date and the office for which he is the candidate of that party. 11 "SEC. 8. The places and manner of holding any primary 12 election or runoff primary election under this article shall 13 be prescribed in each State by the legislature thereof; but 14 the Congress may at any time by law make or alter such 15 regulations. For purposes of this article, the District of Co16 lumbia shall be considered as a State, and elections under this 17 article shall be held in the District of Columbia in such manner as the Congress shall by law prescribe.

"SEC. 9. The electoral college system of electing the 20 President and Vice President of the United States is hereby 21 abolished. Unless the Congress shall by law appoint a dif22 ferent day, there shall be held in each State and in the Dis23 trict of Columbia on the first Tuesday after the first Monday 24 in October in the year preceding the expiration of the term 25 of President and Vice President an election in which the

1 people thereof shall vote for President and for Vice Presi2 dent. In such election, each voter shall cast a single ballot 3 for two persons who shall have been nominated, designated,

or chosen as official candidates for said offices as provided by 5 this article.

"The legislature of each State shall prescribe the places 7 and manner of holding such election, but the Congress may 8 at any time by law make or alter such regulations. The 9 Congress shall prescribe the places and manner of holding 10 such elections in the District of Columbia. There shall be 11 included on the ballot in such election in each State and the 12 District of Columbia the names of each pair of persons who 13 shall have been nominated, designated, or chosen pursuant to 14 this article as official candidates for the offices of President 15 and Vice President.

"Within twenty days after the general election, or at 17 such time as the Congress may prescribe by law, the chief 18 executive of each State and the District of Columbia shall

prepare, sign, certify, and transmit sealed to the seat of the 20 Government of the United States, directed to the President 21 of the Senate, a list of all persons for whom votes were cast 22 for President and for Vice President, together with the

23 number of votes cast for each.

"SEC, 10. On or before the 10th day of November fol

25 lowing the general election, unless the Congress shall by law

1 appoint a different day, the President of the Senate, in the 2 presence of the Speaker of the House of Representatives and 3 the majority and minority leaders of both Houses of the 4 Congress, shall forthwith open all the certificates, count the 5 votes, and cause to be published in an appropriate publica6 tion the aggregate number of votes cast for each pair of per7 sons joined as candidates for President and Vice President. 8 The persons joined as candidates for President and Vice 9 President having the greatest number of votes in all States 10 and the District of Columbia shall be declared elected Pres11 ident and Vice President, respectively, if such number be a 12 plurality amounting to at least 40 per centum of the total 13 number of votes certified. If none of the pairs of persons 14 joined as candidates for President and Vice President shall 15 have at least 40 per centum of the total number of votes 16 certified, a runoff election shall be held between the two 17 pairs of persons joined as candidates for President and Vice 18 President, respectively, who received the highest number of 19 votes certified.

"The Congress shall provide by law, uniform through21 out the United States, for the conduct of any such runoff 22 election, and, unless the Congress shall by law appoint a 23 different day, it shall be held on the first Tuesday after the 24 first Monday in December next following the general elec25 tion. The result of any such runoff election shall be ascer

1 tained and declared in the manner provided by this article

2 with respect to the election the result of which provided the

3 occasion for the runoff election.

"SEC. 11. If, at the time fixed for the counting of the 5 certified vote totals from the respective States the presidential 6 candidate who would have been entitled to election as Presi7 dent shall have died, the vice-presidential candidate entitled 8 to election as Vice President shall be declared elected 9 President.

"The Congress shall provide by law, uniform through11 out the United States, for new elections in the case of the 12 death of both the persons who, except for their death, would 13 have been entitled to become President and Vice President. "SEC. 12. The Congress may provide by appropriate legislation for cases in which two or more candidates receive an equal number of votes and for methods of determining any dispute or controversy that may arise in the counting and

canvassing of the votes cast in elections held in accordance 19 with this article.

"SEC. 13. For the purposes of this article, the voters in

each State shall have the qualifications requisite for elec

tors of Members of the Congress from that State, but noth

ing in this article shall prohibit a State from adopting a less

restrictive residence requirement for voting for President 25 and Vice President than for such Members of the Congress,
