CHAPTER 116.

OF FREE PUBLIC LIBRARIES.

AN ACT to Amend an Act entitled "An Act Providing for the establishment and maintenance of Free Public Libraries," approved March 9, A. D. 1901, being Chapter 136 of Volume 22 of the Laws of Delaware, as amended by Chapter 361, of Volume 22 of the Laws of Delaware, and as further amended by Chapter 114, Volume 23 of the Laws of Delaware, and as further amended by Chapter 106, Volume 25 of the Laws of Delaware.

Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met:

Section 1. That the Act entitled "An Act providing for the establishment and maintenance of free public Vol. 22. Chap. libraries," approved March 9, A. D. 1901, being Chapter 136 of Volume 22 of the Laws of Delaware, as amended by Chapter 361 of Volume 22 of the Laws of Delaware, and as further amended by Chapter 114, Volume 23 of the Laws of Delaware, and as further amended by Chapter 106, Volume 25 of the Laws of Delaware, be amended as follows:

Section 2. By striking out the word "chairman” in line two of Section 2 of the Act aforesaid, as said Section 2 is printed in Chapter 362 of Volume 22 of the Laws of Delaware, and by inserting the word "president" in lieu thereof.

Section 3. By striking out all of Section 2 of the Act 2. Chap. 362, aforesaid, as section 2 is printed in Chapter 362 of Volume 22 of the Laws of Delaware after the words "The sum of" in line eleven of said Section 2, and by inserting in lieu thereof the following:

"Two Thousand Dollars, exclusive of the expenses ac- Annual tually incurred by the members in attending to the work appropriation of the Commission and of sums laid out for necessary printing, postage, stationery and office expenses. The said sum of Two Thousand Dollars, together with the actual expenses of the members as aforesaid and all bills for necessary printing, postage, stationery, and office expenses, shall be paid by the State Treasurer annually to the said Commission out of any funds in his hands as such Treasurer, not otherwise appropriated, upon the order or orders of its President, attested by its Secretary, and this Act shall be the warrant for such payment."

Section 5. By striking out all of Section 5 of the Act Amend Section aforesaid, as said Section 5 is printed in Chapter 362 of Vol. 22 Volume 22 of the Laws of Delaware, after the word "provided" in line four of said Section 5 and by inserting in lieu thereof the following:

"either that at any election held as hereinafter provided, a majority of the qualified electors of said School District then present and voting shall vote in favor of

such establishment or that a sum as hereinafter specified shall be donated to any such District, or the payment of such sum guaranteed as provided in Section 11 of this Act."

Section 6. By striking out all of Section 7 of the Act Chap. 362, aforesaid, as said Section 7 is printed in Chapter 362 of

Creation of new free Pub

Volume 22 of the Laws of Delaware, between the word "election" in line four of said Section and the words "the number" in line nine of said Section 7, and by inserting in lieu thereof the following:

"to be called by said Board or Committee, provided said Board or Committee be petitioned so to do by a number of qualified electors thereof. Such election shall be called for a day not later than sixty days after such petition."

Section 7. By striking out all of Section 9 of the Act aforesaid, as said Section 9 is printed in Chapter 362 of Volume 22 of the Laws of Delaware, after the words "special elections" in line three in said Section 9, and by inserting in lieu thereof the following:

"to be called as hereinbefore provided, whenever such special elections shall be petitioned for as aforesaid, provided that not more than one special election for such purpose shall be called in any one District in any one year."

Section 8. By inserting after Section 10 of the Act aforesaid a new Section as follows:

"Section 11. Whenever the Board of Education or lic libraries in School Committee of any School District in this State,

single, united, consolidated or incorporated, shall be guaranteed for the maintenance and support of a Free

Public Library in such District, a sum equal to the minimum amount required to be raised by a District of its class under Section 10 of this Act, for each year for the three years next ensuing such guarantee, the Board of Education or School Committee of such District shall declare a Free Public Library to be established therein and shall proceed to name a District Library Commission as provided in Section 12 of this Act. Such guarantee may be by gift or devise of money or securities, or other val- Character of uable property or by subscription lists, or by other plan approved by the State Library Commission, provided said guarantee has the sanction of the said State Library Commission.",

Section 9. By changing the numbers of each of the Changing Sections of the Act aforesaid following Section 10 of said Section in Act so that the number of each of the Sections following Vol. 22 said Section 10 shall be changed to the number next succeeding its present number.

Section 10. By striking out all of Section 11 of the Act aforesaid, as said Section is printed in Chapter 362 of Volume 22 of the Laws of Delaware between the word "wherein" in line fourteen of page 703 of Volume 22 of the Laws of Delaware and the words "The members" in the twenty-third line of the aforesaid page 703, and by inserting in lieu thereof the following:

"a Free Public Library has been established under the Amend Section provisions of this Act, shall, as soon as may be, after Vol. 22 such establishment, name the members of a District Library Commission, to compose the first District Library Commission, to act until their successors have been elected by the quaified electors of the District as hereinbefore provided."

Section 11. By striking out all of Section 13 of the Act Amend Section aforesaid, as said Section 13 is printed in Chapter 362 of Vol. 22

Volume 22 of the Laws of Delaware between the word "consider" in line eighteen of page 704 of Volume 22 of the Laws of Delaware, and the words "The said District" in line twenty-five of the aforesaid page 704, and by inserting in lieu thereof the following:

"The said Commission shall also make such report and recommendation to the Board of Education or School Committee of the District as they shall deem proper or advisable."

Section 12. By striking out all of Section 16 of the Act aforesaid as said Section 16 is printed in Chapter 362 of Volume 22 of the Laws of Delaware, and by inserting in lieu thereof a new Section 16 as follows:

Delaware that any single, united, consolidated or incorporated School District in this State has established a Free Public Library therein and has raised by taxation, subscription, gift or otherwise, a sum not less than the sum prescribed by Section 10 of this Act for the class to which such District belongs for the support and maintenance of said Library for the year next ensuing such establishment, that then said State Treasurer shall pay to the District Library Commission of any such School District a sum equal to the lowest sum prescribed in Section 10 of this Act for the class to which such District belongs; and annually thereafter the said State Treasurer shall pay the said District Library Commission a sum equal to one-half of the lowest sum prescribed in Section 10 of this Act for the class to which such District belongs upon the Certificate of the State Library Commission that said District has raised by taxation, subscription gift or otherwise, a sum as hereinbefore provided for the maintenance and support of a Free
